These terms & conditions supersede all previous catalogs, announcements, advertisements, and published information however distributed or implied. All lots are sold "As is, Where is". Your bid is a contract. Failure to pay for successful bids may result in negative feedback and/or legal action.
REGISTRATION:
All bidders, including phone bidders, must register with Kenneth Hutter Auction Company, Inc. and have a bidders number before bidding. Proper identification such as a valid Driver's License or other official identification is required in order to register. Kenneth Hutter Auction Company, Inc. reserves the right to refuse to register any prospective bidder for any reason without recourse or liability.

Catalogs, brochures and other descriptions are guides only based on information from sources believed to be reliable, but their accuracy cannot be guaranteed or warranted. Pre-sale estimates are intended as guides and may not be reflective of actual hammer price. Some of the items may be subject to a reserve defined as a confidential minimum price agreed upon by the consignor and Kenneth Hutter Auction Company, Inc. The reserve will never be higher than the low estimate. We reserve the right to bid on behalf of a consignor with reserved lots by placing successive bids on behalf of the consignor, or bids in response to buyers' bids. BUYER'S PREMIUM: INTERNET BIDDERS 23%.
A buyer's premium of 20% of the hammer price will be charged. Under New York State State Law, both hammer price and buyer's premium are subject to state tax. Anyone with tax exemption status must register beforehand with a copy of the current valid certificate.
PHONE / ABSENTEE BIDS:
We offer this as a convenience to pre qualified bidders on items estimated at $ 300 or greater. You will be called by staff approximately 2 minutes before your lot. While we try to accommodate all interested phone bidders, we cannot guarantee or be held responsible for a missed call therefore we suggest that you leave a back up absentee bid in the event we cannot contact you.

from US $100.00 to US $499.00 US $25.00
from US $500.00 to US $999.00 US $50.00
from US $1,000.00 to US $2,999.00 US $100.00
from US $3,000.00 to US $9,999.00 US $250.00
from US $10,000.00 to US $19,999.00 US $500.00
from US $20,000.00 and above US $1,000.00
Bid increments are at the sole discretion of the Auctioneer. The auctioneer, at his/her sole discretion may not follow the bid increment table at all times.
PAYMENT:
For your convenience, cashiers will be open during the sale for early check out. For those in attendance, all purchases must be paid for in full and picked up within one hour after the conclusion of the Auction. Forms of payment include Cash (In House Only), MasterCard, Visa, Discover, American Express, Bank Wire Transfer, and Paypal. Checks either personal or business, will be accepted at the sole discretion and with prior approval of the Executive Office. Any items not retrieved at the conclusion of the sale, or where no arrangements have been made will be moved to a local warehouse at the purchasers risk and expense.
INTERNET:
Internet sales must be paid for within 10 BUSINESS DAYS of the sale or Seller may void sale. Please do not make payment until you have received an official invoice from Liveauctioneers.com. Acceptable forms of payment include Paypal, MasterCard, Visa, Discover, American Express and Bank Wire Transfer. Charge Cards may also be accepted via the internet through PayPal. Non-Paying Bidder Alerts are issued with resulting negative feedback if not resolved.
SHIPPING:
For shipping inquiries, please contact our offices at 914-630-7900. Clients are welcome to pick up their items from our location or make their own shipping arrangements. We are not responsible for items once they leave our facilities. We highly recommend insurance on all purchases, especially those going overseas.
LIMITATIONS AND ASSUMPTIONS:
Each lot will be sold AS IS, WHERE IS with no warranties or guarantees of condition, fitness, merchantability or suitability. It is the responsibility of potential bidders to carefully inspect each lot to determine condition and contents. All weights, counts and measurements are approximate and measured to the nearest inch. Rugs measured to the nearest half-foot. Ceramics and glass lots are represented as being free of major damage or repairs, unless otherwise stated but may not cover superficial damage or manufacturing defects and where possible, visible damage is shown in photograph. This Warranty does not cover normal wear on furniture, unless otherwise stated. Pieces that are, in our opinion, refinished, are described as such.
The absence of reference to the condition of a clock or lighting device does not imply it to be in working condition or without defects, repairs, restorations, or replacement parts. Bidder acknowledges that all lots were accessible for on hand inspection prior to the Auction and that he or she relied on their own inspection of the lots as well as information listed in the catalog or otherwise provided by Auctioneer, the Auction staff or Seller. All other guarantees of authenticity of authorship, expressed or implied, are hereby disclaimed.
The weights of diamonds and gemstones are approximated, based upon measurements of their physical size. Stones are not taken out of their settings. Watches are not guaranteed to be in working condition.
Prospective buyers should inspect each lot to satisfy themselves as to condition and must understand that any statement made by Kenneth Hutter Auction Company, Inc. is merely a subjective opinion, unless otherwise stated.
